대장동 의혹이 불거진 직후 화천대유 대주주 김만배씨가 김수남 전 검찰총장과 만나 대책을 논의했다고 검찰 공소장에 기재된 것으로 확인됐다. 김수남 전 총장은 김씨가 고위 법조인들에게 거액강남클럽의 보은성 금품을 건넸다는 이른바 ‘50억 클럽’ 의혹에 등장하는 인물이다. 검찰이 손을 놓고 있는 ‘50억 클럽’ 수사의 필요성과 시급성을 거듭 확인해주는 새로운 정황이다.
최근 대장동 사업 수익금 은닉 혐의로 추가 기소된 김만배씨 공소장에는 2021년 9월 김씨가 서울 강남의 한 커피숍에서 김 전 총장을 만나 대책을 논의했다는 내용이 담겨 있다. 김 전 총장은 검찰 출신 ㄱ변호사를 소개해줬다고 한다. 이후 구속된 김씨가 추가 구속에 대비해 ㄱ변호사를 통해 ‘김 전 총장이 나서달라’고 부탁했다는 내용도 나온다. 검찰 공소장 내용이 모두 사실과 부합한다고 단정할 수는 없더라도, 김만배씨와 김 전 총장의 예사롭지 않은 관계를 보여주는 또 하나의 정황임에는 틀림없어 보인다. 앞서 검찰에 제출된 정영학 회계사 녹취록에는 2012년 최윤길 성남시의회 의장이 대장동 업자들한테서 뇌물을 받은 혐의로 수원지검 성남지청의 내사를 받던 당시 김씨가 수원지검장이던 김 전 총장을 만나 사건 무마를 청탁했다는 대화 내용도 들어 있다.
이 밖에도 대장동 업자들이 사업 고비마다 ‘50억 클럽’ 등장인물들한테서 도움받은 정황은 한둘이 아니다. 2011년 저축은행 부실 대출 수사 때 대장동 초기 사업 종잣돈을 부산저축은행에서 불법 대출받은 사건을 검찰이 봐줬고, 이 과정에서 박영수 전 특검이 역할을 했다는 의혹이 대표적이다. 아직은 김만배씨의 주장에 불과하다고 해도 박 전 특검의 딸이 화천대유에 근무하며 대장동 아파트를 분양받은 사실 등에 비춰보면 철저한 조사가 필요한 대목이다. 김씨가 하나은행 등 금융사들을 대장동 사업 컨소시엄에 끌어들이는 과정에서 박근혜 정권 비선실세였던 최순실(최서원으로 개명)씨의 도움을 받았다고 주장하는 녹취도 보도됐다.
이처럼 의혹은 차곡차곡 쌓여가는데 검찰은 여전히 꼼짝도 않고 있다. ‘50억 클럽’ 인물 중 유일하게 기소됐던 곽상도 전 의원이 지난달 뇌물 혐의에 무죄를 선고받은 뒤 시민들의 공분은 더욱 높아지고 있다. 검찰 부실 수사에 대한 의구심도 커졌다. 그런데도 검찰이 나 몰라라 한다면 특검을 서두르는 길밖에 없다.

지난 10일 새벽 1시쯤 유명 힙합 레이블 소속 래퍼 겸 DJ A씨는 이 클럽에서 다른 사람들의 싸움을 말리던 도중 한 남성과 시비가 붙었습니다.
A씨는 이 과정에서 피해자의 얼굴을 수 차례 때린 것으로 전해졌습니다.
현장에서는 폭행 신고가 접수되진 않았습니다.
하지만 폭행을 당한 피해자가 사건이 발생한 당일 강남경찰서로 가 A씨를 폭행 혐의로 고소했습니다.
A씨 소속사 측 관계자는 "아직 자세한 사실을 확인하지 못했다"며 "현재 사태를 파악하고 있다"라고 밝혔습니다.
대장동 비리 의혹의 핵심 인물 김만배 씨가 김수남 전 검찰총장을 만나 대책을 논의했다고 검찰이 김 씨에 대한 공소장에 적시했다. 2021년 9월 대장동 의혹이 집중 보도되면서 검찰 수사가 임박하자 홍대클럽김 씨가 김 전 총장을 찾아가 만났고 변호사도 소개받았다는 것이다. 김 씨가 지난해 자신의 구속기간 연장을 막기 위해 변호사에게 ‘김 전 총장이 나서 달라’고 요청했다는 사실도 공소장에 기재됐다.
두 사람의 관계가 주목받는 것은 김 전 총장이 이른바 ‘50억 클럽’ 중 한 명으로 거론된 인물이기 때문이다. 앞서 지난해 11월 남욱 씨는 재판에서 “김 씨에게서 ‘최윤길 씨 사건을 잘 봐달라고 김 전 총장에게 부탁했다’고 들었다”고 증언했다. 성남시의회 의장으로서 대장동 개발에 깊숙이 개입한 최 씨는 2012년 수원지검 성남지청에서 수뢰 혐의로 내사를 받았지만 무혐의 종결됐다. 당시 김 전 총장은 수원지검장이었다. 이 역시 검찰의 수사로 진위가 가려져야 할 부분이다.
하지만 김 전 총장 관련 의혹에 대해 조사가 이뤄졌는지, 어떤 결론을 냈는지에 대해 검찰은 입을 닫고 있다. 다른 ‘50억 클럽’ 대상자들에 대한 수사도 개점휴업 상태다. ‘재판 거래’ 의혹을 받는 권순일 전 대법관, 딸이 화천대유에 근무하면서 아파트를 특혜 분양받았다는 의혹 등이 제기된 박영수 전 특검에 대한 수사는 소환 조사 이후 1년이 넘도록 진척이 없다. 유일하게 기소된 곽상도 전 의원도 1심에서 뇌물수수 혐의는 무죄 판결을 받아 여론이 들끓고 있다.
대장동 사건에는 성남시의 특혜로 민간업자들이 개발이익을 독식했다는 의혹, 이 과정에서 전관 출신 법조인들이 업자들을 지원했다는 의혹 등이 복합적으로 얽혀 있다. 따라서 50억 클럽에 대한 진상 규명 없이 대장동 의혹을 매듭지을 수는 없을 것이다. 더불어민주당과 정의당은 각각 50억 클럽 특검법안을 발의했다. 검찰은 더 이상 수사를 미뤄선 안 된다. 특검이 도입된다면 왜 50억 클럽을 제대로 수사하지 못했는지도 수사 대상이 될 수 있다는 점을 검찰은 잊지 말아야 한다.

불법촬영을 하고 단체 채팅방에 사진 등을 유포한 혐의로 재판에 넘겨진 래퍼 ‘뱃사공’(37‧김진우)이 생활고에 시달리고 있다며 선처를 호소했다. 피해자는 “뱃사공이 여전히 클럽에 가 유흥을 즐기고 있다”고 반박했다.
15일 서울서부지법 형사6단독 김유미 판사 심리로 성폭력범죄의 처벌 등에 관한 특례법 위반(카메라 등 이용 촬영) 혐의를 받는 뱃사공의 결심공판이 열렸다.
뱃사공은 최후 변론에서 혐의를 인정했다. 그부산클럽는 “두 번 다시 잘못을 저지르지 않겠다”며 “피해자에게 사죄하고 이번 일을 계기로 더 좋은 사람이 되도록 하겠다”고 말했다.
뱃사공 측 변호인은 “자수로 수사가 시작됐고, 본인이 책임을 져야 한다는 의지를 밝히며 신변 정리를 하고 있다”고 했다. 이어 “음원 수익도 없고 활동도 안 하고 있어서 생활고에 시달리고 있다”며 선처를 호소했다.
하지만 이날 재판에 증인으로 나온 피해자 A씨는 “그 자수는 제가 고소를 하지 못하게 협박하다가 한 쇼일 뿐”이라고 반박했다.
A씨는 “뱃사공은 자신이 원하는 해명을 하지 않으면 피해자가 저인 것을 밝히겠다고 협박했다. 그때 사진을 다시 공유했다”며 “무섭고 처참했다”고 말했다. 이어 “뱃사공 측은 앞으로 법적 책임을 묻지 않겠다는 각서를 쓰라고 했다”며 “그 시간 뱃사공은 미리 준비한 변호사를 대동해 자수한 것”이라고 했다.
A씨는 “뱃사공은 이후 제게 (경찰) 조사에 나가지 말라고 회유와 협박했지만 먹히지 않자 피해자가 저라는 사실을 폭로했다”며 “본인은 재판을 앞두고 클럽에 가 유흥을 즐기는 등 반성의 태도를 전혀 보이지 않고 있다”고 했다. 이어 “진심어린 반성과 피해 회복만을 원했지만 사과조차 없었다”고 했다.
A씨는 남편인 래퍼 던밀스까지 피해를 봤다고 했다. A씨는 “아무리 성범죄 피해자라고 해도 유쾌한 이미지가 어울리지 않는다면서 광고 촬영 하루 전 취소됐고, 끝까지 감싸 안아준 남편에게 악플이 달린다”고 했다. 그는 “성범죄 피해자인 제가 더럽냐”며 “피해자인 제가 남편 인생을 망친 것이 아니라 김진우(뱃사공)가 제 인생을 망친 것”이라고 목소리를 높였다.
검찰은 뱃사공에게 징역 1년6개월을 선고해달라고 재판부에 요청했다. 아울러 아동‧청소년 관련 기관 취업제한 3년, 신상정보 공개‧고지 명령 2년도 요청했다. 선고 공판은 4월 12일 열린다.
뱃사공은 2018년 지인이던 A씨를 불법촬영한 뒤 메신저 단체 대화방에 유포한 혐의를 받는다. 지난해 5월 A씨는 자신의 소셜미디어에 “한 남성 래퍼가 다이렉트 메시지(DM)를 통해 만난 여성을 불법촬영하고 사람들에게 사진을 공유했다”는 취지의 글을 올리면서 해당 사건이 수면 위로 드러났다.
A씨는 실명을 거론하지 않았으나 해당 래퍼가 뱃사공으로 지목됐다. 뱃사공은 경찰서를 직접 찾아 조사를 받았고, 경찰은 혐의가 인정된다고 판단해 검찰에 송치했다. A씨는 올 초 뱃사공의 소속사 대표인 DJ DOC 이하늘로부터 허위사실 명예훼손으로 고소를 당했다.

16일 법조계에 따르면 대검찰청은 최근 서울중앙지검 반부패수사1부(부장검사 엄희준)에 검사 4명을 새로 충원했다. 지난 6일 대검 인권정책관실 소속 검찰연구관과 서울중앙지검 형사부 소속 검사 등 총 2명을 파견 받은 데 이어 15일 광주지검과 부산지검 소속 검사 2명을 또 충원했다. 이로써 현재 50억 클럽 수사팀 인원은 16명으로 불어났다.
50억 클럽은 화천대유자산관리 대주주 김만배씨로부터 50억원을 약속 받았다는 의혹이 있는 사람들을 통칭한 표현이다. 최근 뇌물 수수와 관련해 무죄 판결을 받은 곽상도 전 의원을 비롯해 권순일 전 대법관, 박영수 전 특별검사, 김수남 전 검찰총장, 최재경 전 청와대 민정수석 등이 포함됐다. 정영학 회계사의 녹취록에서 김씨가 “50개(50억원)가 몇 명인지 세 보자”며 이들의 이름을 열거했다.
법조계에서는 야당이 50억 클럽 수사가 미진했다고 비난하자 검찰이 수사팀을 매머드급으로 보강하며 강도 높은 수사 의지를 드러낸 것으로 보고 있다. 검찰은 반부패수사1·3부 소속 검사들을 중심으로 50억 클럽 수사를 진행하는 한편 이재명 더불어민주당 대표의 대장동·위례 의혹 수사를 마무리하고 백현동 비리 의혹도 신속하게 종결한다는 계획이다.
앞서 민주당이 지난 6일 발의한 50억 클럽 특검법에는 “대통령이 소속되지 않은 국회 교섭단체가 2명의 특검 후보자를 서면으로 추천하고, 대통령이 후보자 중 1명을 특검으로 임명해야 한다”고 명시돼있다. 여당인 국민의힘을 제외한 교섭단체는 민주당뿐이다. 즉, 대장동 사건의 피의자인 이 대표가 자신을 수사할 특검을 직접 고를 수 있는 셈이다. 검찰로서는 특검법이 통과되기 전 신속하게 사건을 마무리해야만 하는 상황이다.
검찰 내부에서도 “특검법이 통과되면 사실상 검찰 수사는 멈추게 된다”며 수사 속도를 올려야 한다는 반응이 나오고 있다. 수사팀 내에서도 50억 클럽 리스트 인물 전부를 한번에 기소하기보다 혐의가 뚜렷한 인물들이라도 선별적으로 기소하면서 수사 의지를 보일 필요가 있다는 의견이 나온 것으로 알려졌다.
